In The Matter Of DOGE & The "NEED TO KNOW" Issue

A U.S. security clearance is generally required to access classified government files, which might be necessary for certain aspects of determining how to reduce government expenses. However, not all government files are classified. Access to specific classified materials also requires a demonstrated "need to know" (1)  (2)

For roles focused on reducing government expenses, individuals might need access to sensitive but unclassified information, which does not always require a security clearance (2) .   The specific requirements depend on the nature of the information and the responsibilities of the position.  (See Addendum Below Regarding Musk / Ramaswamy SC Issues)

In U.S. security matters, the "need to know" criteria is a fundamental principle that determines whether an individual requires access to specific classified information to perform their job duties. Here are the key aspects: see FACA : Federal Advisory Committee Act.

  1. Relevance to Duties: The information must be directly relevant to the individual's official duties and responsibilities  (1)
  2. Authorization: Even if someone has the appropriate security clearance, they must still have explicit authorization to access the specific information  (2)
  3. Disclosure Officer's Role: A disclosure officer or a similar authority typically makes the determination of "need to know" based on the individual's role and the necessity of the information for their mission (3)
WHO WILL BE EMPLOYED @ DOGE FOR NO PAY ?

The Department of Government Efficiency (DOGE), led by Elon Musk and Vivek Ramaswamy, is still in its early stages, and many details about its operations are not yet clear. However, it has been confirmed that neither Musk nor Ramaswamy will be paid for their roles (1)  (2)

The primary goal of DOGE is to provide advice and guidance on reducing government waste and inefficiency (3)

While specific details about its operating budget have not been disclosed, the initiative aims to cut significant amounts of federal spending, with Musk suggesting potential savings of up to $2 trillion (3)

It will be interesting to see how DOGE develops and what impact it will have on government efficiency.

JARED & IVANKA WORK FOR FREE - CONTRARY TO LAW - IN ABSENCE OF FINAL SECURITY CLEARANCE

Ivanka Trump and Jared Kushner faced significant scrutiny over their security clearances during Donald Trump's first term. Despite initial rejections and concerns from career security officials, their clearances were ultimately approved, reportedly due to intervention from higher-ups (1)  (2)

As of now, there are no recent updates indicating that they have completed any new mandatory security clearance processes for a potential return to the White House. Ivanka Trump has indicated she will not be returning to Washington, D.C., even if her father is re-elected (3)

Standard Form 86 (SF-86) is a U.S. government questionnaire used for conducting background investigations, reinvestigations, and continuous evaluations of individuals under consideration for national security positions (1)  (2

The form collects detailed personal information to assess whether an individual is reliable, trustworthy, and loyal to the United States  (1)

The information provided on SF-86 is used to determine eligibility for access to classified information and suitability for federal employment or contracts (2)

It includes sections on personal history, employment, education, foreign contacts, and financial records (2

The Antideficiency Act (ADA) is a U.S. federal law that prohibits government agencies from:

  1. Obligating or expending funds in advance or in excess of an appropriation (1
  2. Accepting voluntary services for the United States, except in emergencies involving the safety of human life or the protection of property  (1)
  3. Making obligations or expenditures in excess of an apportionment or reapportionment (1) Violations of the ADA can result in administrative and penal sanctions, including suspension, removal from office, fines, or imprisonment  (1)  (2)

The act is crucial for maintaining fiscal discipline within federal agencies and ensuring that government spending aligns with congressional appropriations (2)

ADDENDUM NOTES : MUSK & RAMASWAMY :  SECURITY CLEARANCES

Elon Musk does have a U.S. security clearance due to his role as CEO of SpaceX, which has numerous government contracts, including launching military satellites (1)  (2).  However, his clearance has faced scrutiny and review in the past, particularly due to his public use of marijuana (2)  (3)

There is no public information indicating that Vivek Ramaswamy currently holds a U.S. security clearance. While he has been appointed by President-elect Donald Trump to lead the Department of Government Efficiency alongside Elon Musk (1)  (2)  … this role does not necessarily require a security clearance.

SIDEBAR

"In 1982, President Ronald Reagan created the Grace Commission, led by wealthy businessman J. Peter Grace, the CEO of W. R. Grace & Company, a chemicals business. About 150 business people volunteered for the commission, which ultimately recommended 2,500 reforms, according to the Ronald Reagan Presidential Library - In the 1990s, President Bill Clinton created the National Performance Review with the goal to create a government that would work better and cost less, Kamarck said. The group was staffed with civil servants who understood the bureaucracy, and many of whom had frustrations with it, she added ...The group had some successes in streamlining operations and paring costs, eventually cutting more than 300,000 jobs, according to a study from the Congressional Research Service. Kamarck noted that the group also focused on integrating technology into departments at a time when the internet was just emerging, leading to efficiencies such as online tax filing." CBS NEWS
